These Terms & Conditions (“Terms”) govern your access to and use of vakansim.nl, the VakanSIM application, and VakanSIM eSIM products and related services (collectively, the “Service”). By purchasing or using the Service, you agree to these Terms.
1. Definitions
Service – the VakanSIM website, application, eSIM products, data packages, top-ups, support, and related services.
User / You – a person or entity accessing or using the Service.
eSIM – an embedded SIM profile supplied digitally for use on a compatible device.
Package – the country, regional, or global mobile-data plan (and, where expressly offered, calling/SMS features) purchased through VakanSIM.
Account – your registered VakanSIM profile, if applicable.
Order – a purchase of an eSIM, package, top-up, or related product.
2. Eligibility and Lawful Use
You must have legal capacity to enter into a purchase agreement or use the Service with the permission of a parent or legal guardian where required.
You must use the Service lawfully and comply with applicable telecommunications, sanctions, export-control, consumer, and other laws. You may not use the Service for fraud, abuse, unauthorized access, harassment, unlawful communications, or other illegal activity.
3. Device Compatibility and Carrier Lock
Before purchasing, you are responsible for confirming that the intended device supports eSIM, is not carrier-locked in a way that prevents installation or use, and supports the networks and technical requirements relevant to your destination.
Device models and regional variants can differ. Compatibility information provided by VakanSIM is intended to assist you but does not replace verification of your exact device model and settings.
4. Purchasing, Delivery and Installation
After a successful purchase, VakanSIM may deliver the eSIM through the website, app, email, QR code, activation code, or another supported digital method.
You are responsible for providing an accurate email address and protecting activation information. Some eSIM QR codes or activation credentials may be usable only once.
Do not delete an installed eSIM unless instructed by VakanSIM support or unless you are certain it can be reinstalled. Deleting an eSIM may make the profile unusable.
5. Activation, Validity and Data Usage
Unless a package states otherwise, package validity generally begins when the eSIM first connects to a supported network at the destination. The exact activation rule, validity period, data allowance, supported countries, and available networks are shown in the applicable package details.
Data usage is measured by the relevant telecommunications systems. Background apps, system updates, cloud synchronization, video, hotspot use, and other device activity may consume data.
Unused data expires when the package validity period ends unless the package explicitly states otherwise.
6. Coverage, Speed and Network Availability
VakanSIM works with third-party telecommunications providers and local mobile network operators. Coverage, speed, latency, 4G/5G availability, network selection, and service quality depend on local infrastructure, congestion, geography, device capability, operator policies, maintenance, and other factors outside VakanSIM’s direct control.
We do not guarantee uninterrupted connectivity, a specific network operator, a specific speed, or continuous 4G/5G availability. Temporary outages, roaming restrictions, or network changes may occur.
7. Data Roaming and Device Settings
Many travel eSIM packages require Data Roaming to be enabled for the VakanSIM eSIM. You are responsible for selecting the correct SIM/eSIM for mobile data and configuring your device according to the installation instructions.
To avoid charges from your home carrier, review your primary SIM’s roaming and data settings before travel. VakanSIM is not responsible for charges billed by another carrier because of your device configuration.
8. Prices, Payments and Taxes
Prices are displayed before purchase in the applicable currency. Payment may be handled by third-party payment processors or app stores. We do not control independent payment-provider terms.
Applicable taxes, exchange rates, bank fees, or payment-provider charges may affect the final amount. We may change prices for future purchases at any time.
9. Refunds and Cancellations
Refund eligibility is governed by the VakanSIM Refund Policy and applicable consumer law. Because an eSIM is a digital product that may be delivered immediately and may become usable or activated shortly after purchase, cancellation or refund rights can depend on whether the eSIM has been installed, activated, used, or otherwise consumed.
Where mandatory consumer law grants additional rights, those rights remain unaffected. Purchases made through an app store may also be subject to that store’s refund procedures.
10. Top-Ups
Where a package supports top-ups, you may purchase additional data or validity through the available VakanSIM channels. Top-up availability, price, validity, and activation rules may differ by destination or eSIM profile.
11. Accounts and Security
You are responsible for keeping your account credentials, email access, QR codes, and activation credentials secure. Notify VakanSIM support promptly if you suspect unauthorized access or misuse.
12. Acceptable Use
You may not resell, redistribute, reverse engineer, manipulate, abuse, or use the Service in a way that interferes with networks, systems, other customers, or telecommunications partners.
We or our network partners may apply reasonable technical controls, suspend service, or restrict abusive or fraudulent activity where necessary to protect the Service or comply with law.
13. Intellectual Property
Unless otherwise stated, VakanSIM’s website content, application, branding, text, graphics, software, and designs are owned by or licensed to VakanSIM and are protected by applicable intellectual-property laws.
You may not reproduce, distribute, modify, or commercially exploit protected materials without permission, except as permitted by law.
14. Third-Party Telecommunications Services
Mobile connectivity is provided in cooperation with third-party carriers, roaming partners, and network operators. Their network rules and technical limitations may apply to your use of the eSIM.
VakanSIM may change underlying network partners or routing where reasonably necessary to maintain or improve the Service.
15. Service Changes and Suspension
We may update, modify, discontinue, or replace packages, features, supported networks, or technical systems. Where practical, changes affecting an existing paid package will be handled in a way consistent with applicable consumer law.
We may suspend or terminate access where there is fraud, abuse, a material breach of these Terms, a security risk, a legal requirement, or a restriction imposed by a telecommunications partner.
16. Limitation of Liability
To the fullest extent permitted by applicable law, VakanSIM is not liable for indirect, incidental, special, or consequential losses arising from use of the Service, including losses caused by network outages, device incompatibility, incorrect device settings, third-party carrier failures, or circumstances beyond our reasonable control.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights.
17. Indemnification
To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful misuse of the Service, violation of these Terms, or infringement of third-party rights.
18. Governing Law and Consumer Rights
These Terms are intended to be governed by the laws of the Netherlands, subject to mandatory consumer-protection rules that may apply in your country of residence.
Any jurisdiction clause must not deprive consumers of protections or courts available to them under mandatory applicable law.
19. Changes to These Terms
We may update these Terms to reflect changes in the Service, business operations, partners, or legal requirements. The current version should be published on vakansim.nl with the latest revision date. Material changes will be communicated where required by law.
